Monsieur le Premier Ministre,

La lettre qui suit a pour objet de vous exprimer notre profonde inquiétude concernant la situation injuste du Dr. Hassan Diab, citoyen canadien extradé et détenu en France depuis le 14 novembre 2014. Nous vous exhortons de remédier à cette erreur de justice et de ramener Hassan chez lui au Canada.

Le Dr. Diab est un professeur de sociologie qui a enseigné à Carleton University et à l’Université d’Ottawa. Il est père de deux jeunes enfants qui vivent à Ottawa. La France l’accuse d’avoir commis un attentat devant une synagogue à Paris en 1980, tuant 4 personnes et blessant des douzaines d’autres.

Les preuves pèsent largement en faveur de l’innocence du Dr. Diab. Toute sa vie il s’est opposé au fanatisme et à la violence, ce que confirment ses amis, ses collègues et ses connaissances de longue date. [1] Il a toujours nié toute implication dans ce crime; il condamne vivement l’antisémitisme, le fanatisme et la violence. Ses empreintes digitales, les empreintes de sa paume, sa description physique, et son écriture ne correspondent pas à celles du suspect. Le juge d’extradition canadien a qualifié les preuves contre le Dr. Diab de « tortueuses, très confuses, et suspectes » et il a déclaré que « la perspective d’une condamnation lors d’un procès équitable paraît improbable. » Cependant le juge s’est senti obligé, d’après la loi d’extradition canadienne, de faire extrader le Dr. Diab. [2]

Le dossier contre le Dr. Diab est fondé sur des informations secrètes de source inconnue qui ont peut-être été obtenues sous la torture. Ces informations, à cause de leur nature problématique, furent retirées de l’audience d’extradition au Canada. Pourtant elles restent dans le dossier en France. Human Rights Watch a recensé l’utilisation d’informations secrètes lors de procès injustes qui se sont déroulés sous le régime de la loi anti-terroriste en France. [3]

Robert J. Currie, professeur de droit à Dalhousie University, écrit dans l’Ottawa Citizen que « Hassan Diab devrait être rapatrié et notre loi d’extradition devrait être corrigée. » Il fait remarquer que la situation d’Hassan est « le résultat direct, même logique, de l’état actuel de la loi d’extradition canadienne. Spécifiquement, notre loi empêche les individus passibles d’extradition de s’opposer de manière cohérente à la demande d’extradition d’un état étranger lorsque cet état ne présente pas de preuves suffisamment fiables. » [4]

Pendant les deux dernières années les juges d’instruction français en charge du dossier du Dr. Diab ont mèné des enquêtes et interviewé plusieurs témoins. Ils ont déterminé que le Dr. Diab n’était pas en France en octobre 1980. Ils ont déclaré que des « éléments concordants » prouvent l’innocence du Dr. Diab. Huit fois on a ordonné la libération sous caution du Dr. Diab. Mais chaque fois la Cour d’Appel française, à la demande du Parquet, a contremandé l’ordre. Des avocats français appellent le cas d’Hassan « sans précédent » et observent que la Cour s’agrippe à Hassan pour ne pas être accusée de « laxisme dans le contexte actuel de la lutte anti- terroriste en France ». [5]

Le Dr. Diab a passé les neuf dernières années de sa vie soit en prison, soit dans des conditions de liberté provisoire très strictes au Canada. Cette détention sans fin du Dr. Diab vingt heures par jour dans une cellule de prison – bien que des juges d’instruction aient ordonné sa libération plusieurs fois – rappelle les frustrations d’autres Canadiens détenus à tort à l’étranger, tel que le journaliste et auteur Mohamed Fahmy, détenu en Egypte. En août 2015, lorsque vous étiez dans l’opposition, vous l’avez défendu avec force en déclarant que le Premier Ministre Stephen Harper « a l’obligation d’utiliser tous les moyens à la disposition du Cabinet du premier ministre pour aider les citoyennes et citoyens canadiens lorsqu’ils sont injustement emprisonnés à l’étranger. Son inaction doit cesser. » [6]

Monsieur Fahmy lui-même, le 23 mai dans le Toronto Star, a abordé « la réalité pénible qui hante quotidiennement Diab et sa famille » et l’a comparée à la sienne en disant que vous pourriez « intervenir directement auprès du nouveau gouvernement français pour ramener Hassan chez lui. » [7]

Faisal Kutty, professeur adjoint à Osgoode Hall Law School à Toronto a écrit dans le Toronto Star du 4 Mai que la poursuite du Dr. Diab est un travesti de justice, en ajoutant : « Autrefois le Premier Ministre Trudeau appelait le gouvernement Harper à intervenir dans de telles situations. En effet, autrefois Monsieur Trudeau défendait les citoyens. Le cas de Monsieur Diab est maintenant mûr pour effectuer une telle intervention. » [8]

Nous ajoutons nos voix à celles des milliers de Canadiens, à celles des nombreuses organisations de la société civile et des droits de l’homme à travers le Canada qui appellent le gouvernement canadien à intervenir dans le cas du Dr. Diab. Ces voix comprennent Amnesty International, L’Association Canadienne des Libertés Civiles, l’Association des Libertés Civiles de la Colombie-Britannique, L’Association canadienne des professeures et professeurs d’université, et bien d’autres. [9], [10]

Alex Neve, Secrétaire général d’Amnesty International Canada, déclare que « c’est le moment pour le gouvernement canadien de prendre parti pour un de ses citoyens. » [11] Bernie Farber, militant pour les droits de l’homme et ancien directeur du Congrès juif canadien, et Mira Sucharov, professeur associé de sciences politiques à Carleton University, écrivent: « il est clair qu’Hassan Diab n’est pas en train d’obtenir justice d’après les normes canadiennes. Cela doit changer. » [12] Michael Enright, journaliste et présentateur de l’édition du dimanche de la CBC, demande « Pourquoi le gouvernement canadien ne s’est-il pas donné du mal pour faire libérer le Professeur Diab étant donné que les preuves présentées à l’audience d’extradition étaient bien douteuses? » [13] L’avocat de Hassan, Donald Bayne, l’un des défenseurs les plus estimés de ce pays, appelle ce cas « la recette classique pour une conviction à tort d’un citoyen canadien ». [14]

Monsieur le Premier Ministre, nous vous exhortons d’empêcher la conviction à tort du Dr. Hassan Diab, et d’utiliser tout le pouvoir de votre Cabinet pour aider Hassan, citoyen canadien injustement détenu à l’étranger, à rentrer chez lui au Canada.

La situation kafkaïenne du Dr. Diab dérive des actes d’un gouvernement précédent. On ne peut pas défaire ces actes. Cependant votre gouvernement a le pouvoir d’atténuer et de finir par arrêter le mal et la souffrance que lui et sa famille continuent de subir quotidiennement.
