At the event, Hassan and his lawyer, Mr. Donald Bayne, offered a compelling presentation on how Hassan’s case raises serious concerns about failures in the Canadian justice system and Canada’s extradition laws.

The session generated strong interest and meaningful engagement. It was inspiring to witness the level of enthusiasm and support from attendees in Winnipeg and beyond.

2. Send a Letter to the Minister of Justice

Send a letter to the Minister of Justice, Mr. Sean Fraser, urging him to refuse any future extradition request for Dr. Diab and to put an end — once and for all — to this ongoing miscarriage of justice.

Background

The injustice began in 2008 when Dr. Hassan Diab, a Canadian citizen living in Ottawa and teaching at Carleton University and the University of Ottawa, was arrested for alleged involvement in a 1980 Paris synagogue bombing. He has always maintained his innocence and asserted that the case is one of mistaken identity.

After lengthy extradition proceedings, Hassan was extradited to France in 2014 on the basis of deeply flawed evidence. He spent more than 38 months in a French prison, much of it in solitary confinement. A thorough investigation by two of France’s most respected investigative judges found no grounds to put him on trial. Crucially, key evidence — including fingerprint analysis, handwriting comparisons, and a strong alibi — excluded him as the suspect. In January 2018, the investigative judges ordered his immediate release, and he returned to his home and family in Canada.

Yet the injustice did not end there. Shockingly, in April 2023, a political trial held in absentia at the Paris Special Assize Court disregarded the investigative judges’ findings and declared Hassan Diab guilty. The proceedings were marred by serious irregularities, including the use of discredited “intelligence”, the suppression of exculpatory evidence, defamatory claims, and perjured testimony. This declaration of guilt represents a profound miscarriage of justice.

Today, Dr. Diab lives under the constant threat of a second extradition to France. Canada has a responsibility to protect the rights of its citizens and to stand against injustice. The Canadian government must act now and reject any future extradition request.

On June 7, 2023, the Standing Committee on Justice and Human Rights (JUST) released its report, “Reforming Canada’s Extradition System”. The case of Dr. Hassan Diab was highlighted as a stark example of the shortcomings of Canada’s Extradition Act. The report sets out 20 recommendations to address these shortcomings — reforms that the Canadian government must implement without delay to prevent further injustice.
